And all because her dog bit my little boy

Question:

oh dear,here we go again
this morning i had enviromental health fone me they say they've recieved numerous complaints about trin barking
trin neva barks, how do i this, well, its got 2the point that i leave a tape recorder going when i go out just to make sure,no joke
This is the story...........about a year ago......
i live at num 1,theres alady (if thats wot you can call her)at number 3.
i have to walk down a path to get out of my house, this path goes past her house.
neway, her staffy cross kept jumping at the fence (which is 4ft at the most)wen i walked past,he would be lunging and snapping over the fence, the path is only 3ft wide so you had to practly jump in the hedge or run past so he didnt get you i have 2 young kids,i was more worried about them

i told this lady at num3 ova and ova again about the prob, she was nice enough about it,every few weeks or so she'd keep him in for afew days then put him out the front again 4 him 2 just sart lunging and snapping again.

then as time went on,i told her more and more, she'd do the same again(keep him in),only wen she started puting him out the front again and he snapped, if she caught him doing it she would come out of her house and hit the poor mite with an horse wip

well,i was discusted and told her so too,i also said wouldnt putting him in the back garden help!?
so,for afew weeks she put him out the back.

then just over 4weeks ago i was walking max(my son) back from nursery, we walked past num3's house,
b4 i realised the dog was in her front garden he had lunged over the fence and was attached to maxs arm,the dog had a solid grip, max was screaming,
i had to smack the dog on the nose to get him to let go
luckily max was wearing a duffle coat and he didnt manage to hurt him, physically neway.
later in the day i spoke 2num 3,she said 'im having the little b******** put down'.
but the nxt morning he was out the front garden again, that was it,i flipped,i called the police.
the police went to c num3 a put and a control order on the dog
i thought that would be the end of it and she'd keep him out the back
well i dont no what she did with the poor mite but she doesnt have him nemore and within days of wot happened she bought another dog
(wots worse is ive been told this is the 4th dog that shes had put down/got rid of 4bitting)

since that day ive been bombarded with letters and phone calls about trin barking, wot a coincidence
ive even been threatened with eviction by my housing association,im fighting it ofcourse as the idiots slipped up and told me it was num3 making the allegations aswell as her best bud at num4

do you think i went ova the top phoning the police?wot would of you done in my situation?

Answer:

I don't think you could have done anything else, having already tried to deal with her direct.
As for the complaints about barking, hopefully the officials will realise that it is just a vendetta & there is no truth in the allegations. Try to remain polite & calm when dealing with the people handling the complaints. If they can see that you are polite & sensible they will be far more ready to listen to your side of things & if he isn't barking, you should be able to prove it.
Hope it sorts itself out, but must be a nightmare living next to someone like this.

I think you were well within your rights to phone the police. The next child that got bit may not have been wearing a duffle coat.

I seriously don't think there's anything to worry about if Trin really doesn't bark. If you've left a tape recorder out and can't hear anything on the tapes, she can't be barking loud if at all, and environmental health will do tests to see the noise is bad enough to warrant any action.

They won't go soley on the allegations from number 3 and 4, and you have every right to fight it all the way.

That doesn't really help though because she's putting you through a load of grief because of her own stupid fault.

I'd also be onto the RSPCA and explain the situation and that you have seen her whip the dog and the allegations of the amount of dogs she's had destroyed because of biting. They probably won't be able to do anything but it'll be kept on record in case of future complaints against her.

She shouldn't be owning any dogs by the sounds of things.

I think you totally did the right thing. It doesn't make you feel very good doing it I know. I had to do the same thing with a dog a couple of weeks ago. Still ongoing and all because the person won't fix his fence and keep his dogs in
If you know that your dog is not barking then next time you get a call or a letter. Attack back. Tell them it's a neighbour stirring it and invite them to put recording instruments up, you have nothing to hide. It's not nice getting a letter. I did once and it was all lies. My next door neighbour actually wrote a letter in my defence saying it was lies.
Stick to your guns. Sad woman (not you, your neighbour )

Answer:

i phoned the r.s.p.c.a about the dog that bit max, they said they couldnt do anything and i had to fone the police,i even said she was hitting the poor mite with a wip!
i didnt want her to have him put down,it wasnt the dogs fault,if he had been owned by some1 else it would of been different. to make matters worse the dog in question she rehomed from, you guessed it,the r.s.p.c.a
im trying not to let it get to me, i have nothing to hide

Answer:

You did the right thing, it sounds as though she can't look after her dogs at all. I think i would be phoning the RSPCa too, she shouldn't have any dog at all!!
